A group of victims, together with their lawyer, has officially filed a complaint against “Mom Tak” (Kamolkan Suwanbut) and “Pa Beer” for fraud related to online gold sales, stating they will pursue the matter in court and will not settle.
The complaints stem from issues faced by customers who purchased gold online from Kamolkan, the owner of a supplement business. Customers discovered that the promotional gold flowers received as bonuses were rejected by other gold shops, raising doubts about the standard quality of the purchased gold. The Minister attached to the Prime Minister’s Office has ordered the Consumer Protection Committee to investigate the gold quality.
Ken-do, a representative of almost 20 victims out of 155 who suffered a total loss of 2 million baht, submitted evidence to the Central Investigation Bureau, requesting legal action against Kamolkan and her counterpart Kwanthap Boonareng (Pa Beer) for fraud.
Previously, victims attempted to report the matter at a local police station, but their complaints were dismissed on the grounds that fraud was not applicable since they received the goods without verifying their weights beforehand.
One victim revealed they had kept quiet about their ordeal for nearly two years due to fear of defamation charges. However, an increasing number of victims and better legal understanding have motivated them to seek justice.
The attorney announced that among the 155 victims, the total loss amounts to 2 million baht, but most of them are from outside the province or abroad, complicating the consolidation for legal action. The evidence provided includes purchasing records, bonuses, and live-stream sales clips. The charges will be for fraud against the public due to its criminal nature.
Some victims have chosen to withdraw complaints in exchange for refunds, which is their individual right, but the remaining victims pledged to pursue their legal cases to the fullest without settling.
Attorney Pat, who is assisting with the case, stated on social media that arrangements were being made for those unable to visit the police station in person to file complaints online, with further guidance to be provided. For international victims, representation through a local authority may be required to proceed with the case.
